simple logic would help in this case instead of relying on 50 year old gossip rumors.

HMV is the copyright in this case. HK is just contract employee.
He didn't get any royalty payment from it. Movie producer own the movies copyright.
So HK cannot be sued for copyright infringement.
Furthermore any infringement has to go to court litigation.
Either money has to be exchanged or the offending material has to be
withdrawn from the market.
Unless that can be provided as proof instead of someone's memory
of reading gossip magazine than it has to be taken with grain of salt.

Brits. and When Brits were stealing from Indians. For example
Parcheesi is an American adaptation of the Indian Cross and Circle game Pachisi.
Cotton Gin was rework of device used in India for hundreds of year.

The important factor is to know whether a song has its roots in western song..and nothing else. Actually, We do know that every MD has taken inspiration from one or more western songs, which in no way belittle the Legendary Composers of that time. With the kind of work load and the tastes of Producers and Heroes coming in their way, a composer has a tough scene to manage.

Lets not get emotional about this copyright issue. Its ok to get inspired as long as you don't rip the full thing.
Many have put a new twist to other songs.
For example some people claim the song from Kagaz Ke Phool - Kehte hain jisse shaadi is inspired from the hit
Doris Day Song - Whatever will be- from the Hitchcock movie The man who knew too much. But on listening I find it
quite different.
And I guess sometimes producers must be demanding inspirations and somewhere you have to say yes.

Thanks for sharing this song. I am kind of surprised to see that composer Hemantda has chosen Subir Sen as the playback singer. Subir Sen (and Dwijen Mukherjee)'s voice is so similar to that of Hemantda's voice.
