In the meantime, it's very easy for a woman to apportion the rape blame on a man. Don't we see that all the time in the movies when a female character tears of her blouse, dishevels her hair, and throws away her saree? These tell-tale signs plus bruises and tears are important indication of rape. Penetration is the most important factor otherwise it will amount to just attempt to rape.
Another factor is the consensual sex, i.e. having sex with consent. If at least that's proven, then the judge will have to look for the age of the woman. If she is over 16, then Shiney should consider himself lucky. If not, then he is damned.
Lastly, if both the above are missing, then the door is open to levy the charges of Molestation.
Confessions, if any, can always be retracted in a court of law by an accused person.
Let's see how the defence counsel prepares his brief.
