Not a Pundit, but will throw some light on this nevertheless.... No, GF, the movie was not also called Woh Mili Thi...this song was originally in Anari 1975...and the same song was also included in Woh Mili Thi 1986... The moot point is that MD for "Anari" was Laxmikant Payrelal, who had composed this song.....while the MD for "Woh Mili Thi" was Bappi Lahiri...but LP was not given the credits for this song in "Woh Mili Thi" at all....so the question that arises is, who owns the rights to a song??? Is it the Producer or the Director or the MD or the Singers or the Lyricts??? Wish the answer to this had been on some logical basis, then perhaps Amit Kumar would have released the unreleased songs of KK long time ago.... eskayes

Is it the Producer or the Director or the MD or the Singers or the Lyricts??? Wish the answer to this had been on some logical basis, then perhaps Amit Kumar would have released the unreleased songs of KK long time ago.... I see.thanks for the clarification. Well, in my opinion, once the MD records gets paid and hands over the songs it generally belongs to the producer(assuming he has paid) or whover paid for it and buys them. the producer of Anari would have owned the rights of the song directed by LP.and he can use it anyway he likes. Now comes the question of credits.Yes he must give credit to LP wherever he uses. However, if the same song ir "re-recorded" by Bappi under section 52 of copyright act(this is the now most famous T-Series technology) then the credit goes to bappi and not LP.(of course morally he is bound to give credit to Lp but it is only moral and not legal!) when the movie is released or even before that the producer sells the rights to a music company and thereafter they are the whole and sole owners of the music.no one else has any claim on it. Now as regards Amit releasing KK songs, HE JUST CANNOT DO IT. because a singer/lyricist/percussionist/guitarist et al have no rights on the song.they are like workers in a factory.they do a job and get paid.they do not own the production!! tell you what,AK even tried once and lost the case. He wanted royalty to be paid on the re releases of his father's songs by all the music companies. In an interview he was asked about it and he said "forget it,it is water down the bridge now" (he had lost the case i a court.) Now the last songs of KK would now be owned by 1.either RD, in cases where not sold to the producers.after his death who owns the rights and who physically owns the tapes?? 2.Or different producers who would have released them in the future movies.or may not be alive etc. 3.Or music companies who would have by now released definitely. Amit kumar can only play an organiser to get some of the songs released using his cult. That's all Any different views..i welcome.. ....NIRANJAN & GURUFAN...

I perfectly agree with you GuruFan...the rights of the songs cannot belong to singers, lyricst, MD, Director, etc. I had read about the Amit Kumar episode..and yes, he cannot bring those songs out now nor could he keep them with him (unless he agrees to delete it from his computer/music holder within 24 hours
![]() Just one issue here.....if the rights of Anari music were with the Music Company, then, when it was used in Woh Mili Thi, ideally they should have acknowledged that this song was courtesy the Music Company even if the Music Company for the two movies were same (ye gana HMV or whatever ke saujanya se)...but it was not done....i think Music Company may just have rights to distribute the songs while the rights would remain with producer (like distributors of a movie vis-a-vis the producer, who owns the right)....in which case there was no need for any acknowledgement if the producers of the two movies were same...complicated, huh.....(GF, reminds me of LAB....now this is a secret between two of us) Now, as for the credits, I think it would have only fair to give credit to LP since the music and tune was same, even if one were to assume that it was re-recorded; which doesn't seem to be the case here in anycase... eskayes
